When Providers Can Share Information Without Consent

HIPAA does allow some exceptions, especially when it’s in the patient’s best interest or for safety:

  • In a crisis or emergency, if the patient is incapacitated or a danger to themselves or others, providers can share relevant information.
  • Providers may share information with people involved in the patient’s care (like a caregiver or family member) if the patient does not object and the provider thinks it’s appropriate.
  • If the patient is a minor, parents or legal guardians generally have access (unless state law or special circumstances restrict it).
